We offer you a newly furnished holiday apartment. Two double rooms, a living kitchen, a bathroom, an additional shower room, and a terrace invite you to relax. Since we also enjoy cycling, we have tailored our offer especially for touring cyclists, e-bikers, and mountain bikers with a dedicated bike room. This provides a secure storage option for bikes, charging possibilities for batteries and bike accessories, a pump, a repair stand, some tools, common spare tubes, and chain oil are available. General Terms and Conditions

for the rental of a holiday accommodation

The following general terms and conditions apply to the use of the above-mentioned holiday accommodation:

1. APPLICABILITY

The general terms and conditions apply to the rental of the holiday accommodation for accommodation as well as all other services provided by the landlord for the guest.

1. BOOKING

The booking of the holiday accommodation is confirmed by the booking confirmation, which is sent to the guest after the online booking. With the receipt of the booking confirmation, the booking is thus legally binding. By booking, the present general terms and conditions as well as the house rules, which have been made accessible to the guest in advance, are also accepted.

1. STAY

The holiday accommodation, including inventory and the facilities belonging to the house, must be treated with care by the guest. The cleaning of the holiday accommodation is to be carried out by the guest during the rental period. The guest must also ensure that when leaving the apartment, the windows are closed and the lights are turned off.

The use of the holiday accommodation is reserved for the guests specified at the time of booking. If the holiday accommodation is used by more persons than agreed, a separate fee of 15.00 euros per person/day must be paid for these. Subletting and transfer of the holiday accommodation to third parties is not permitted.

During the stay, the house rules apply, which are included in the guest folder or can be viewed online at www.ferienwohnung-an-den-weingaerten.de. In case of violations against the GTC or the house rules, the landlord is entitled to terminate the rental relationship immediately and without notice. There is no legal claim to a partial refund or compensation.

1. PAYMENT

The guest is obliged to pay the prices applicable for the rental of the holiday accommodation and the additional services used by him from the landlord.

For short-term bookings and bookings of less than 7 overnight stays, the amount is to be paid in advance by bank transfer or upon agreement upon arrival in cash or by card.

For bookings of 7 overnight stays or more, a deposit of 50% is to be made. A booking only becomes binding when the deposit has been received in the landlord's account.

1. CANCELLATION

The guest has no right to free cancellation. In case of cancellation, the guest is obliged to pay a part of the agreed price as compensation. The amount of compensation is based on the following schedule:

Cancellation up to

45 days before the start of the rental: 10% of the rental price

44 – 33 days before the start of the rental: 30% of the rental price

32 – 22 days before the start of the rental: 60% of the rental price

21 – 12 days before the start of the rental: 80% of the rental price

11 days before the start of the rental – start of rental: 90% of the rental price

A cancellation must also be made in writing.

The landlord can cancel the booked service without giving reasons up to 10 days before arrival. Any payments already made will then be refunded to the guest in full. A later termination of the contract is also permissible in the event of force majeure or other unforeseen circumstances that make the booked stay impossible. In this case, liability is limited to the refund of the rental price.

In the case of justified cancellation, the guest has no claim for damages. Liability for travel and hotel costs is also excluded. We recommend taking out travel cancellation insurance.

1. LIABILITY

The landlord is liable within the framework of due diligence for the proper provision of the rental object. Liability for any failures or disruptions in water, internet, or electricity supply as well as events and consequences of force majeure are excluded. The landlord also assumes no liability for the loss of items or theft in the house or on the property.

For damages caused by the guest that were willful or grossly negligent, the guest is liable. The arrival and departure also take place at the guest's own risk and liability. In addition, a fee of 15.00 euros is due in case of loss of the keys to the holiday accommodation.

1. WRITTEN FORM

Changes and additions to these general terms and conditions require written form. This also applies to the amendment of this written form clause. No oral agreements have been made.

1. SALVATORIAN CLAUSE

If individual provisions of these general terms and conditions are ineffective or unenforceable or become ineffective or unenforceable after knowledge, the effectiveness of the remaining general terms and conditions shall not be affected. Instead of the ineffective or unenforceable provision, the effective and enforceable regulation shall apply, the effects of which come as close as possible to the economic objectives pursued by the parties with the ineffective or unenforceable provision.
