House and Bath Regulations for the Swimming Area “Waldsee Argenthal”
§ 1 General
1. The house and bath regulations serve the safety, order, and cleanliness in the area of the swimming area.
2. The house rules are binding for all guests. By accessing the premises, every visitor acknowledges these as well as all other orders issued to maintain traffic safety.
3. The facilities of the swimming area and the premises must be treated with care. In case of misuse, culpable contamination, or damage, the guest is liable for the damage. Any waste must be disposed of by oneself.
4. Guests must refrain from anything that contradicts good manners as well as maintaining safety, peace, and order. Disturbance, harassment, or endangerment of other persons is not permitted. Furthermore, photographing and filming of strangers and groups without their consent is prohibited. For commercial purposes and for the press, photographing and filming requires prior consent from the operator.
5. Provided ashtrays must be used. Sunbathing areas must be kept free of cigarette remains.
6. The staff of the municipality of Argenthal exercises house rights over all visitors. Instructions from the staff must be followed. Guests who violate the house rules may be temporarily or permanently excluded from visiting the swimming area. Additionally, a house ban may be issued. Failure to comply with the house ban will result in a criminal complaint for trespassing.
7. In case of thunderstorms, the water must be left.
8. Guests are not allowed to use musical instruments, sound playback devices, televisions, or other media (e.g., mobile phones) that disturb other guests.
§ 2 Opening Hours and Access
1. The opening hours will be publicly announced. After the opening hours, the premises must be vacated immediately.
2. The operator may restrict the use of the swimming area, e.g., during events. 3. Access is not permitted:
a) Persons under the influence of intoxicating substances,
b) Persons bringing animals,
c) Persons wishing to use the premises or swimming area for commercial purposes.
d) Persons suffering from a reportable infectious disease or open wounds.
4. Persons who cannot move safely without assistance, children under 7 years, blind persons, mentally ill persons, and persons with seizures, e.g., epileptics, are only allowed to use the swimming area together with a suitable accompanying person who has reached the age of 18.
3 Liability
1. Guests use the swimming area, including the facilities, at their own risk, without prejudice to the operator's obligation to maintain the premises in a traffic-safe condition. The operator is not liable for force majeure and accidents as well as for defects that cannot be immediately recognized even with the usual care.
2. The operator is not liable for the destruction, damage, or loss of items and valuables brought onto the premises of the swimming area.
3. The operator or their agents are liable, except for damages resulting from injury to life, body, or health, only in cases of intent or gross negligence.
§ 4 Use of the Swimming Area
1. The usage time of the swimming area is not limited in time and is based on the opening hours.
2. The use of the swimming area is at one's own risk. There is no water supervision. Parents or accompanying persons must supervise their children or persons in their care and are liable for them. Access to the swimming area is only through the marked entrances. Jumping, pushing, or throwing other persons into the swimming area is not permitted.
Jumping into the swimming area, especially headfirst, is prohibited due to the associated special danger. 3. When using sports and play equipment, disturbances to other guests must be avoided. Guests must show consideration for each other.
4. Bringing and consuming spirits, barbecuing, open fires, as well as nude bathing or sunbathing are prohibited.
5. Navigating the swimming area with boats, surfboards, or stand-up paddles is prohibited.
§ 5 Exceptions
The house rules apply to the general operation of the swimming area. Exceptions to this regulation may be allowed for special events without the need for a special repeal of the house rules.
