General Terms and Conditions and Accommodation Contract
STATUS: August 30, 2019
SCOPE OF APPLICATION
a) These terms and conditions apply to contracts for the rental of hotel rooms for accommodation, as well as all other services and deliveries provided for the guest by the Country Hotel Karrenberg.
- b) The subletting and further leasing of the provided rooms as well as their use for purposes other than accommodation require the prior written consent of the hotel, whereby § 540 Abs. 1 Satz 2 BGB becomes a condition, as far as the guest is not a consumer.
- c) The guest's terms and conditions only apply if they have been expressly agreed in writing beforehand.
- CONTRACT CONCLUSION a) We are pleased about your booking at the Country Hotel Karrenberg. By ordering/bookings of rooms, spaces, arrangements (packages) or other services, a contract is concluded between you (the guest) and the Country Hotel Karrenberg (hotel) in accordance with the following conditions after verbal, written, or electronic confirmation of the hotel. All further confirmations requested by the hotel serve additionally for internal planning and are not decisive for the conclusion of the contract.
- b) If it is an order/booking for several guests, the orderer is liable for all guests/participants registered by him and for all obligations arising from this contract.
- c) If the reservation confirmation of the hotel deviates in one or more points from your order/booking, the content of the reservation confirmation becomes contractual content, unless you (the guest) object immediately, but at the latest with check-in (acceptance of the services).
- d) If the booking is made through an intermediary (e.g., travel portals like HRS.de or booking.com), the confirmation of the intermediary to the guest is only auxiliary. The booking can be rejected by the Country Hotel Karrenberg for an important reason (overbooking, incorrect rates, etc.).
- e) If a deposit or advance payment is requested for a reservation/booking by the hotel and this is not paid on time within the agreed period, the reservation promise/confirmation becomes void.
III. ARRIVAL AND DEPARTURE a) The room occupancy (check-in) is possible from 3:00 PM on the day of arrival. The room return (check-out) must be done by 10:00 AM on the day of departure.
- b) If you wish to check out after 10:00 AM (late check-out), please inquire at the reception. If the Country Hotel Karrenberg agrees to the late check-out, a half room price is to be paid for departure until 6:00 PM and the full overnight price of an extended night for departure after 6:00 PM. We ask you to arrive at reserved rooms by no later than 6:00 PM. If no spontaneous arrival after 6:00 PM is communicated in advance or your reservation is not fully or partially prepaid, the hotel can dispose of the rooms otherwise.
- PROVIDED SERVICES a) The duration and scope of the contractual services of the hotel result from the information in the respective valid price list, the hotel's homepage, or the agreements made. Deviating agreements from the valid price list must be made between you (the guest) and the hotel and must have been confirmed in writing by the hotel. With the appearance of a new price list, all previous prices lose their validity.
- b) All offers are subject to change. Offers that are sent by post, email, or fax have a maximum validity of 7
- c) Our half board includes a breakfast buffet and a 3-course choice menu or buffet for dinner.
- d) If the guest does not take a meal for any reason, he has no claim for reimbursement or reduction. This also applies to partial refunds.
- e) The prices stated in the current price list or in other lists and confirmations include service charges and the currently applicable VAT.
- f) If there is an increase in VAT after the conclusion of the contract, we must pass this increase on. If more than 6 months lie between the conclusion of the contract and the arrival date, we also reserve the right to make price changes without prior notice.
- PAYMENT a) As a guarantee of a group reservation of 10 or more persons, a deposit of 50% must be paid within 30 days after booking confirmation. The remaining payment is to be made at the latest upon departure, unless there is another written agreement between the orderer and the hotel.
- b) If no other advance payment has been requested by the hotel, the total amount of your booking/reservation is due upon departure.
- c) For a stay of more than 5 days, the hotel may issue an interim invoice.
- d) If the guest is in default of payment, the hotel can terminate the agreement with immediate effect. The assertion of further damages, in particular the loss of other rentals, remains reserved to the hotel.
- e) If the guest terminates his stay prematurely, he is still obliged to pay for the booked/confirmed total service. Exceptions are excluded; unless the guest proves that the hotel has failed to make a reasonable re-letting.
- f) The place of performance for the guest's payment obligations is Kirchberg/Hunsrück. This also applies if the guest has been credited with the payment.
- g) Payments from credit card companies are made solely for fulfillment purposes.
- h) If payment by invoice has been agreed, payment must be made, unless otherwise agreed, within 10 days of receipt of the invoice without deduction.
- CANCELLATIONS AND FEES A cancellation by the customer from the concluded contract is only possible if a right of withdrawal has been expressly agreed in the contract, a statutory right of withdrawal exists, or if the Country Hotel Karrenberg expressly agrees to the cancellation of the contract. The agreement of a right of withdrawal as well as any consent to a cancellation of the contract should be made in text form. If a date for the free exercise of the right of withdrawal has been agreed, the customer can withdraw from the contract until then without triggering payment or damage claims.
The customer's right of withdrawal expires if he does not exercise it in text form against the hotel by the agreed date.
Basically, unless a different period has been specified in the offer, confirmation, or contract in writing, the following regulation applies to individual bookings (up to 10 rooms or 10 overnight stays):
From Sunday to Thursday inclusive, a free cancellation is possible up to 2 days before arrival.
From Friday to Saturday inclusive, a free cancellation is possible up to 7 days before arrival.
On public holidays and their adjacent weekends, a free cancellation is possible up to 30 days before arrival.
Bookings of 10 rooms or more or with more than 10 overnight stays are considered group bookings. The following free right of withdrawal applies here, unless a different period has been specified in the offer, confirmation, or contract in writing:
From 10 to 20 overnight stays up to 30 days before arrival
From 21 to 35 overnight stays up to 60 days before arrival
From 36 to 90 overnight stays up to 90 days before arrival
from 91 overnight stays up to 120 days before arrival
If a right of withdrawal has expired, there is also no statutory right of withdrawal, and if the Country Hotel Karrenberg does not agree to a cancellation of the contract, the Country Hotel Karrenberg retains the claim to the agreed remuneration despite non-utilization of the service. The Country Hotel Karrenberg has to credit the income from other rentals of the rooms as well as the saved expenses. If the rooms are not rented out otherwise, the Country Hotel Karrenberg can demand the contractually agreed remuneration and offset the deduction for saved expenses. In this case, the customer is obliged to pay 90% of the contractually agreed price. He is free to prove that the aforementioned claim has not arisen or not in the required amount.
VII. LIABILITY a) The guest or the organizer is liable to the hotel without proof of fault for damages caused by him or his guests.
- b) In case of key loss by the guest or contract partner, he is liable for the replacement of the locking system.
- c) In case of a false alarm triggered by the guest or contract partner, he is liable for all damages incurred by the hotel (fire department and personnel deployment, etc.).
- d) For food brought or delivered (e.g., wedding cakes) as well as food taken from the restaurant, we cannot assume any liability.
- e) The hotel is not liable to the guest or the contract partner if the provision of services becomes impossible in the event of a strike or due to force majeure, in particular water damage. The hotel will make every effort in these cases to procure equivalent services.
- f) The hotel is not liable to the guest according to the provisions of §§ 701 f BGB (up to 100 times the room price, maximum 3,500.00 euros) for money and valuables unless the hotel or its staff is at fault, or the valuables or money were handed over to the hotel for safekeeping against receipt.
- g) If the guest brings a vehicle and parks it in a parking space provided by the hotel, liability is limited to damages demonstrably caused by hotel staff.
- h) In the case of events, it is the responsibility of the contract partner to insure brought items against theft, damage, or destruction. The hotel's liability is excluded.
VIII. TERMINATION a) If the guest uses the rooms provided to him for a purpose other than the agreed one, the hotel has an extraordinary right of termination.
- b) If the hotel has justified reason to assume that a planned guest event endangers the smooth operation of the business, the safety, or the reputation of the house or the guests, the hotel can terminate the contractual relationship extraordinarily and without notice.
The hotel's claim to the agreed remuneration remains in these cases despite extraordinary termination.
- c) An extraordinary right of termination on the part of the hotel also applies in cases of force majeure or internal unrest.
- VOUCHERS Vouchers can be redeemed as soon as the corresponding payment has been received in the hotel's business account. The original voucher must be presented upon arrival. The hotel can refuse the service in case of missing presentation.
- OTHER a) The provision of rooms and other areas is subject to a fee. The provision of the same to third parties is only permissible with the written consent of the hotel.
- b) Animals may only be brought after prior consent of the hotel and against payment of a surcharge.
- c) Wake-up calls, information, mail, and goods shipments are provided without obligation. The guest cannot derive any claims of any kind from this. Lost property (left items) will only be sent upon request against reimbursement of shipping costs. The statutory retention period is 6 months.
- d) In the case of free transportation of the guest by the hotel, liability is limited according to the car insurance for personal and property damage.
- e) If excursions, transfer, ship, and bus trips or other services are provided by a third party on behalf of the hotel, this party is liable to the guest according to its respective GTC or applicable legal provisions. The hotel's liability is excluded in this case.
- f) At events in the Country Hotel Karrenberg, bringing food and drinks is generally excluded. The decoration of the event rooms requires a special agreement unless it is merely the usual table decoration.
- g) For celebrations, a service surcharge of 30€ per service staff and per started hour will be charged from 1:00 AM. The need for service staff is reserved by the service management.
- h) The house rules of the Country Hotel Karrenberg apply. Consideration must be given to other guests. A reasonable night’s rest must be maintained from 10:00 PM. Attention must be paid to order, cleanliness, economical energy consumption, and careful handling of the building and its inventory.
- i) When registering multiple persons as well as for group, travel, seminar, and conference events, the hotel must be sent the number and possibly participant lists up to 3 days before arrival/event start. Political events must be clearly marked in the inquiry.
- j) The communication and promotion of trips associated with a stay at the hotel require prior written approval of the respective advertising measure by the hotel. GENERAL a) For any disputes arising from this contract and its fulfillment, as far as legally permissible, the seat of the hotel Kirchberg / Hunsrück is agreed.
- b) Should any of the aforementioned provisions be invalid, this does not affect the validity of the other provisions. Instead of the invalid provision, a valid regulation that comes as close as possible to it shall take effect.
- c) German law applies. The application of the UN Sales Law and conflict of laws is excluded.
- d) The Country Hotel Karrenberg does not participate in dispute resolution procedures before consumer arbitration boards.
- e) By acknowledging the terms and conditions, the guest confirms that he has taken note of the privacy policy.
